1. Acceptance of Terms

Welcome to EzyRunners! These Terms of Service ("Terms") govern your access to and use of the EzyRunners platform, including our website, mobile applications, and services (collectively, the "Services").

EzyRunners is a product of EzyDevOps Solutions Private Limited, a company registered in India ("Company," "we," "our," or "us").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Definitions

• "Customer" - Any individual or business that uses our Services to send or receive deliveries
• "Runner" or "Delivery Partner" - Independent contractors who perform deliveries through our platform
• "Enterprise" - Business entities that have entered into an enterprise agreement with us
• "Platform" - The EzyRunners website, mobile applications, and all related services
• "Delivery" - The transportation of goods from one location to another facilitated through our Platform

3. Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Be capable of forming a binding contract
• Not be prohibited from using the Services under applicable laws
• Provide accurate and complete registration information

For Delivery Partners, additional eligibility requirements apply as specified in the Delivery Partner Agreement.

4. User Accounts

4.1 Account Creation

You must create an account to use certain features of our Services. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password confidential
• Accept responsibility for all activities under your account

4.2 Account Security

You are responsible for safeguarding your account credentials. Notify us immediately if you suspect unauthorized access to your account.

5. Services Description

5.1 Platform Services

EzyRunners provides a technology platform that connects Customers with independent Delivery Partners for last-mile delivery services. We do not employ Delivery Partners; they are independent contractors.

5.2 No Guarantee

While we strive for reliable service, we do not guarantee:

• Availability of Delivery Partners at all times
• Specific delivery timeframes
• Uninterrupted or error-free service

6. Pricing and Payments

6.1 Pricing

Delivery charges are calculated based on distance, vehicle type, demand, and other factors. Prices are displayed before you confirm a delivery.

6.2 Payment

You agree to pay all charges incurred through your account. We accept various payment methods as displayed on the Platform. All payments are processed securely through our payment partners.

6.3 Refunds and Cancellations

• Cancellations before Runner assignment: Full refund
• Cancellations after Runner assignment: Cancellation fee may apply
• Cancellations after pickup: Partial or no refund
• Disputes must be raised within 24 hours of delivery

7. User Responsibilities

7.1 For Customers

• Provide accurate pickup and drop-off locations
• Ensure packages are properly packed
• Do not include prohibited items in shipments
• Be available at pickup/delivery locations
• Treat Delivery Partners with respect

7.2 Prohibited Items

You may NOT use our Services to deliver:

• Illegal substances or contraband
• Weapons or explosives
• Hazardous materials
• Stolen goods
• Live animals (unless specifically permitted)
• Items requiring special licenses

8. Limitation of Liability

8.1 Package Liability

Our liability for loss or damage to packages is limited to:

• The declared value of the package at the time of booking
• Maximum liability of ₹5,000 per delivery (unless additional insurance purchased)

8.2 General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from third-party actions
• Circumstances beyond our reasonable control

9. Intellectual Property

All content on the Platform, including logos, designs, text, graphics, and software, is owned by or licensed to EzyDevOps Solutions Pvt Ltd and is protected by intellectual property laws.

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks without authorization
• Reverse engineer our software
• Scrape or harvest data from our Platform

10. Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activities
• Abuse or harass Delivery Partners or staff
• Provide false information
• Fail to pay charges when due

You may terminate your account at any time by contacting support. Outstanding balances remain due upon termination.

11. Dispute Resolution

11.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at support@ezydevops.com to attempt informal resolution.

11.2 Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.

11.3 Arbitration

Disputes may be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

12. Indemnification

You agree to indemnify and hold harmless EzyDevOps Solutions Pvt Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the Platform

13. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes through:

• Email notification
• In-app notification
• Posting on our website

Continued use of the Services after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
